The plaintiff in error, hereinafter called defendant, was convicted in the district court of Tulsa county on a charge of murder, and his punishment fixed at life imprisonment in the state penitentiary. Motion for new trial was filed, overruled, proper exceptions taken, and the cause is now on appeal in this court.

The information alleged that the defendant, Walter M. Yeager, on the 10th day of January, 1927, in Tulsa county, with premeditated design to effect the death of one E. A. Craig, shot him with a revolver or pistol, and did then and thereby cause the death of the said E. A. Craig.…
