Nos corresponde determinar si erró el Tribunal de Pri-mera Instancia y el Tribunal de Apelaciones al concluir que en este caso no procedía dictar sentencia sumaria puesto que existía una controversia de hechos materiales. Respon-demos en la afirmativa. Además, el presente caso nos per-mite desarrollar en nuestra jurisdicción la doctrina del sham affidavit que adoptamos en SLG Zapata-Rivera v. J.F.
