MEMORANDUM OPINION

Before the Court are two post-trial motions: (1) plaintiff/counter-defendant’s motion for a new trial as to the fraudulent misrepresentation and promissory fraud claims (Aug. 15, 2013 [ECF No. 163] (“New Trial Mot.”)); and (2) plaintiff/counter-defendant’s motion for a new trial or, in the alternative, for remittitur.
