On June 14, 2005, Ricky Mills was shot and killed by two Orange County deputy sheriffs. Plaintiff Marie Burks, as personal representative of Ricky Mills, brings the instant action against those two deputy sheriffs in their individual capacities and against the Sheriff of Orange County in his official capacity. 1 Plaintiff alleges that the Defendants violated the Fourth and Fourteenth Amendments to the U.S. Constitution, and she brings claims for these alleged constitutional violations pursuant to 42 U.S.C. § 1983.
