delivered the opinion of the Court,

This is an appeal from Division 1 of the Criminal Court of Davidson County, Tennessee, by Clayton-Dawson, who is being detained in the Tennessee State Penitentiary under a sentence of death by electrocution for the crime of rape. The appellant was convicted of such crime in the Shelby County Criminal Court on April 16, 1960 and the jury fixed his punishment as aforesaid. An appeal was perfected from said conviction to this Court and on October 7, 1960 the judgment was affirmed in an opinion written by Mr. Chief Justice Prewitt and concurred…
