FOR THE COURT:

¶ 1. Push Phillips was terminated from his position as a deputy sheriff with the Hancock County Sheriffs Department because he left the state for approximately thirty-six to forty-eight hours after Hurricane Katrina made landfall in Hancock County in August 2005. The Civil Service Commission for the Hancock County Sheriffs Department affirmed Sheriff Steve Garber’s decision to terminate Phillips, and the Hancock County Circuit Court affirmed the commission’s decision.
