MEMORANDUM OPINION AND ORDER

Central States, Southeast and Southwest Areas Pension Fund and Howard McDougall, Trustee, (collectively “Central States” or “the Fund”) filed suit against Sara Lee Bakery Group, Inc. (“Sara Lee”) pursuant to Section 515 of the Employee Retirement Income Security Act, 29 U.S.C. § 1145 (“ERISA”) to collect allegedly delinquent pension contributions.
