This case, which has been before this court on two prior occasions (69 AD2d 544; 76 AD2d 228), again comes to us on remand from the United States Supreme Court for further consideration in light of that court’s recent decision in United States v Johnson (457 US_, 50 USLW 4742 [June 21, 1982]), wherein it was held that the rule announced in Payton v New York (445 US 573) be applied retroactively to all convictions that were not yet final at the time the decision was rendered.1 The Supreme Court concluded in Payton that, absent exigent circumstances, the Fourth…
