Defendant, with another, was charged by information with robbery, and, on separate trial, was convicted and sentenced to imprisonment for seven years. He appeals from the judgment and from an order denying his motion for a new trial.
There was evidence tending to show that one James Saito (a Japanese), while on his way home about one or two o’clock of the morning of February 5, 1903, was “held up” by three men on Sacramento Street, in San Francisco, two of whom held pistols to his head, while defendant went through his pocket and took from his person a gold watch and eighty cents in coin.…
