THOMPSON, J.

Irving Kessler sued Dudley Gray, an attorney, for professional negligence. Gray admitted negligence in failing to bring a cross-complaint filed by Kessler against Milton Koomer and Joel Bressel to trial within the required period so that the cross-complaint was dismissed for want of prosecution. Gray, however, resisted Kessler’s right to recover on the theory that Kessler’s lawsuit against Koomer and Bressel would not have been successful.
