On October 23, 2002, a jury found the defendant, Derek A. Sivo (defendant), guilty of one count of first-degree child abuse, in violation of G.L.1956 § 11 — 9— 5.3(b)(1). 1 The defendant appeals his conviction, alleging that the trial justice erred in: (1) denying the defendant’s motion for a judgment of acquittal; (2) instructing the jury that the state was not required to prove that the defendant intended to inflict physical injury upon the child; (3) determining that the Family Court had subject-matter jurisdiction over this case; (4) directing a…
