This is an interesting case, and several points of practice are novel in this court. Before a distribution of the estate of testator, George G. Lake, may be ordered in this proceeding, it becomes necessary to consider the meaning and effect of paragraph fourth of the will. Testator therein provided that his residuary estate should be divided into as many separate, equal shares as he should leave children surviving, and he made similar provisions and directions in regard to each share.
