BLACK v. Ervin
Indiana Court of Appeals
1Opinion of the CourtGonas, J.
A dispute arose between appellants and appellee as to the boundaries of the land included within the terms of a lease and as to the rights granted by the lease. Appellee, as a remote assignee of the lease and the owner of a building on, the leased premises brought this action against appellants, successors in interest to the feodum simplex title of the real estate, seeking damages for trespass and injunctive relief. Judgment was rendered in appellee’s favor, in which judgment the court set forth a specific description which it found to be the land intended to be covered by the lease.
