At a former trial of this case on the petition of the Southern Railway Company, a foreign corporation, an order was entered for its removal to the United States District Court on the ground that the circuit court sustained a demurrer to the evidence by the Only resident defendant. On appeal to this court, referring to well-established principles, it was shown that the situation thus disclosed did not.furnish sufficient justification for the removal, and the judgment was reversed.
