On October 23, 2001, plaintiffs Kenneth McCulloch (“McCulloch”), his wife Carmen Otero Ferreras, and their conjugal partnership (collectively “plaintiffs”) brought this action for collection of money and breach of contract under Puerto Rico law against defendants Norberto Velez Ma-lave, his wife Nitza Denise Leon, their conjugal partnership, and Caribbean Bakers, Inc.
