Nellie Carlin, as administratrix of the estate of Julius Mell, deceased, brought an action against the city of Chicago and Thomas F. Pickham to recover damages for the benefit of the next of kin of the deceased for the negligent killing of said Julius Mell. The declaration contained three counts, in each of which it is charged that the death of Julius Mell, a child six years of age, was caused by the negligence of the defendants in failing to guard or protect a large piece of boiler or header-pipe which was negligently placed and permitted to remain on Fourteenth street near the plant or…
