SUMMERS, Justice.

Appellant Ray Rosteet was indicted by the Grand Jury of Calcasieu Parish for the December 20, 1967 killing-,of Paul Terrenova III by his criminal negligent operation of a motor vehicle, while intoxicated, in violation of Article 32 of the Criminal Code.

On October 11, 1968 Rosteet entered a guilty 'plea, and he was sentenced to serve one year at hard labor, with the sentence suspended and Rosteet placed on probation for one year, subject to the conditions outlined in Article 895 of the Code of Criminal Procedure1 and the additional condi*865tion that he not -violate any law,…
