On August 17, 1911, W. T. Townes, defendant in error, in the district court of Pottawatomie county, sued plaintiff in error, Chicago, Rock Island & Pacific Railway Company, in damages for personal injuries. After demurrer to the amended petition was filed and overruled, defendant answered, in effect a general denial, and pleaded contributory negligence and assumption of risk. After reply, in effect a general denial of all the facts set forth in the defenses pleaded, there was trial to a jury, and judgment for plaintiff for $5,000, and defendant brings the case here.
