The facts, as presented by the petition of the applicant and the return to the writ of the officer having him in custody ,%re substantially as follows: At the July term, 1870, of the County Court for Sacramento County, the applicant was indicted, by a Grand Jury impaneled by said Court, for the alleged crime of murder.
