1. When the verdict was returned, and the foreman in the presence and hearing of the other jurors was asked upon which count the verdict was rendered, no juror dissented from his answer. The inference of assent from their omission of any expression of dissent 'is conclusive. The practice in this instance is not unusual. South Hampton v. Fowler, 54 N. H. 197, 201. So far from being objectionable, it is frequently a convenient one, if not quite indispensable.
