In September of 1999, David Velez was violently assaulted by his cellmate at the Milwaukee County jail. He filed suit under 42 U.S.C. § 1983 alleging that Michael Johnson, a deputy sheriff, violated his constitutional rights by failing to adequately respond when Velez, seeking protection, pushed an emergency call button in his cell prior to the attack.
