Defendant was charged with two counts of first-degree sexual abuse for conduct involving a five-year-old child. The state offered evidence that defendant possessed two pairs of children’s underwear at the time that he committed the charged acts. Defendant opposed the admission of the evidence as irrelevant under Oregon Evidence Code (OEC) 401 1 and unfairly prejudicial under OEC 403. 2 The trial court admitted the evidence under OEC 404(3) 3 to show that defendant had touched the victim with a sexual purpose rather than accidentally.
