Defendants Modern Insurance Agency and Ok Z. Kim (collectively, “Modern”), each residents of New York, moved to dismiss the plaintiffs Amended Complaint as against them for lack of subject matter jurisdiction pursuant to Fed. R. of Civ. P. 12(b)(1). The plaintiff, Abraham Natural Foods Corp., made a cross-motion to remand the case to state court pursuant to 28 U.S.C. § 1447(e).
