RUDOLPH, J.,

This case is before the court at this time on a motion by respondent to dismiss the appeal. The plaintiff is named as follows: “E. A. Ruden, Superintendent of Banks of the State of South Dakota, in charge of the Ware & Griffin Bank of Clark, South Dakota, a corporation, now insolvent, for the purpose of liquidation.” Judgment was entered against the plaintiff by the trial court on the 7th day of July, 1933, and the appeal was taken by the plaintiff to this court on July 5, 1934.
