Defendant was convicted by a jury of first-degree premeditated murder, MCL 750.316(l)(a), first-degree felony murder, MCL 750.316(l)(b), arid mutilation of a dead body, MCL 750.160. He was sentenced to life imprisonment for each murder conviction and 50 to 120 months’ imprisonment for the mutilation conviction, all sentences to be served concurrently. Defendant appealed, and while that appeal was pending, a successor trial court judge granted his motion for a new trial. The prosecutor then filed a cross-appeal from that order.
