STOKES, Justice.

Appellee, Albert Hibler, brought this action in thé 108th district court of Potter county against appellant upon a certificate of insurance issued by it upon the life of Mattie Hibler, his wife, in which he was the beneficiary, dated August 26, 1933, in the sum of $1,000, together with 12 per cent, penalty and reasonable attorneys’ fees. He alleged in the alternative that if the policy ór certificate had become forfeited, appellant unconditionally accepted all premiums thereon from and after such forfeiture until the death of the insured and retained all premiums after her…
