TUCKETT, Justice:

The defendants were found guilty of burglary in the second degree and from the verdict and the judgment of the court sentencing the defendants to imprisonment they have appealed. ;

The defendants were apprehended during the nighttime while they were within the Lockhart Company building in Clearfield, Utah. The Lockhart Company building was situated between the Barlow Furniture Company building and the Clearfield State Bank building.
