MEMORANDUM OPINION

ELLIS, District Judge.

Introduction

This case presents novel questions concerning the construction of Virginia’s non-suit statute and the expansion of legal malpractice damages to include recovery for mental anguish. Plaintiff in this professional malpractice action alleges that the lawyer defendants were negligent and reckless in their representation of her in a child custody battle with the result that she lost custody of her two children.
