(after stating the facts as above). Taking the most favorable view of the case made by the appellant, we are of the opinion that the judgment below was right. Giving to the evidence all that may- be claimed for it by counsel for the appellant, the case may be stated -as follows: That Samuel Haigh at the time he made his application to purchase the coal land in question agreed to convey one-half thereof to John D. Sherman and William O.- Sher-'' man, and that his brother, George W. Haigh, was to have some interest in the remaining portion of the land, and that therefore the entry of the land…
