This case grows out of certain proceedings upon an execution issued out of this court in the case of Hooper v. McAllister, 115 Mich. 174. That was a case for the partition of a certain farm in Calhoun county in which complainant, Hooper, claimed an undivided five-sixths interest. From a decree granting him but a one-half interest, he appealed to this court from the circuit court .for Calhoun county, and his title to an undivided five-sixths interest was established..
