MONTEITH, Chief Justice.

This is an appeal in an action brought by Helen Larsen, appellee, against Galveston Theatres, Inc., appellant, for damages for personal injuries sustained by appellee as the result of a fall on the stairway leading into the ladies’ rest room of the Queen The-atre, in Galveston, Texas.

Appellee in her petition alleged that the injuries complained of were directly caused by the negligence of appellant in the construction, maintenance and lighting of the stairway leading into the rest room of said theatre.
