This action is brought under the Lien Law to establish Hens upon a certain fund in the hands of the treasurer of the city of Niagara Falls arising out of the construction of a pubhc school building by the board of education of said city. The building of the school was properly authorized by a vote of the electors of the city, and the necessary funds to pay for its construction paid into the hands of the city treasurer. The board of education of the city was charged with the duty of erecting the building. It made a contract for its construction with “ Norman McLeod,…
