Appeal from a judgment of the County Court of Saratoga County (Scarano, J.), rendered May 12, 2008, which resentenced defendant upon his plea of guilty of the crime of burglary in the third degree.
The relevant facts are fully set forth in our prior decision in this matter (People v Ruddy, 51 AD3d 1134 [2008], lv denied 12 NY3d 787 [2009]). Briefly, defendant pleaded guilty in 2005 to burglary in the third degree and was sentenced to time served plus five years of probation.
