HOLTZOFF, District Judge.

This is the trial of an action brought by the plaintiff, William Lias, to set aside an order directing his deportation as an alien illegally in the United States. The plaintiff, in addition to questioning the validity of the deportation proceeding itself and the final order therein, also challenges the ruling of the Immigration authorities that he is an alien. The plaintiff claims to be a natural born citizen of the United States and seeks a declaration of his nationality.
