Special ground 1 of the motion for new trial complains that the trial judge erred in disallowing an amendment to the affidavit of illegality setting up the defense of non est factum. Special ground 2 o-f the, amended motion assigned as error the ruling of the trial judge in striking the defendant’s claim for damages against W. J. Norton and dismissing him as a party to the case.
