This was an action for double damages under section 809, Revised Statutes, 1879, for killing the plaintiff ’ s cow. The action was originally commenced before a justice of the peace against the Kansas City, ¿Springfield and Memphis Railroad Company, but, -in the circuit court, an amended petition was filed so as to make it an action against the Kansas City, Fort Scott and Memphis Railroad Company. The plaintiff had a *576verdict and judgment for fifty dollars, and defendant appeals.
