SMITH, Judge.

Plaintiff appeals from a judgment against him based upon a jury verdict find*505ing for the defendant in an intersection collision case. On appeal plaintiff challenges the giving of an instruction on contributory negligence and the failure of the trial court to order a new trial because of the alleged misconduct of the jury.
