Richard Mark Gergel, United States District Court Judge *506This matter is before the Court on Defendants' motion to dismiss. For the reasons set forth below, the Court denies the motion.

I. Background

Plaintiff Tina Bairefoot was convicted of shoplifting miscellaneous merchandise worth approximately $163 from a Walmart. (Dkt. No. 1 ¶ 57.) She was not represented by an attorney and she was not advised of her right to counsel. (Id. ¶¶ 59-66.)
