MEMORANDUM AND ORDER
MacLAUGHLIN, District Judge.
This matter is before the Court on defendant’s motion to dismiss and on plaintiffs’ motion for consolidation. Defendant's motion will be denied. Plaintiffs’ motion will be granted.
FACTS
This action is a citizen suit brought under section 505(a) of the Clean Water Act (Act), 33 U.S.C. § 1365(a). Plaintiff Atlantic States Legal Foundation (ASLF) is a non-profit New York corporation with members in various states (including Minnesota) dedicated to protecting and restoring natural resources, particularly water resources.
