The action below was assumpsit. Plaintiff sought to recover from the defendant building and loan association the sum of $1,000, alleged to be due him under the terms of a written contract, having for its subject matter an extension of the time fixed for payment of the principal of a certain bond, accompanied by a mortgage on the premises at No. 664 North 11th Street, Philadelphia.
