The Nelson-Pedley Construction Company, Inc., one of the defendants, entered into a written agreement with the Commonwealth to construct for the latter the first part of what is known as “South Office Building No. 2 in Capitol Park at Harrisburg.” The other defendant is the surety for the completion of the contract; but no defense peculiar to the surety is alleged, and hence its agreement need not be considered.
