Appeal by the defendant, by permission, from an order of the Supreme Court, Queens County (Erlbaum, J.), dated February 22, 2011, which denied, without a hearing, his motion pursuant *1015to CPL 440.10 to vacate a judgment of the same court (Joy, J.), rendered January 25, 1993, convicting him of grand larceny in the fourth degree, upon his plea of guilty, and imposing sentence.

Ordered that the order is affirmed.
