Appeal by the People from an order of the Supreme Court, Queens County (Braun, J.), dated July 20, 2012, which, after a hearing, granted the defendant’s motion pursuant to CPL 440.10 to vacate a judgment of the same court (Browne, J.), rendered May 29, 1998, convicting him of attempted criminal *788sale of a controlled substance in the third degree, upon his plea of guilty, and imposing sentence.
Ordered that the order is reversed, on the law, the defendant’s motion pursuant to CPL 440.10 to vacate the judgment is denied, and the judgment is reinstated.
