This case is before the court on a writ of error from the Circuit Court of the Eleventh Judicial Circuit of Florida in and for Dade County. Suit was instituted in the Circuit Court of Dade County, Florida, on the 5th day of May, A. D. 1935, by “Frances Aiken, joined by her husband and next friend, William W. Aiken,” against The Miami Jockey Club, a Florida corporation, seeking damages for an injury alleged to have occurred on the 23rd day of January, A.
