Plaintiff Habib Aoraha Dukhow commenced this action in response to the United States Citizenship and Immigration Service’s delay in processing his naturalization application. Presently before the Court is the agency’s motion to dismiss for lack of subject matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1) or, in the alternative, to remand this matter to the United States Citizenship and Immigration Service (“CIS”) for a determination on Plaintiffs naturalization application.
