GARWOOD, Circuit Judge:

This is an appeal of a district court judgment denying a Motion for Correction, or Reduction of Sentence under Fed.R.Crim.P. 35.

FACTS

In 1984, appellant, Bernard Hanyard, was indicted for violating 26 U.S.C. § 7203 by willfully failing to timely file federal income tax returns for the years 1977, 1978, and 1979. Pursuant to a plea agreement, he subsequently pleaded guilty to one count of the multi-count indictment, and the remaining counts were dismissed.
