Mindy Linda Panitch, by her guardian ad litem, commenced this action in August, 1972, seeking declaratory and injunctive relief. She charged that form er § 115.82(7) of the Wisconsin statutes, as applied pursuant to a policy statement of the Wisconsin Department of Public Instruction dated December 18, 1969, denied certain handicapped children equal protection of the laws. It was urged that these children were effectively denied a program of education at public expense.
