This matter comes before the court pursuant to the Defendant Hy-Vee, Ine.’s, (“Hy-Vee”) motion for summary judgment. [Dkt. 15]. Plaintiff Dona G. Woehl (“Woehl”) filed a response in opposition to summary judgment on May 29, 2009. [Dkt. 18]. On June 12, 2009, Hy-Vee filed a reply to Woehl’s response in opposition to summary judgment. [Dkt. 23]. For the reasons set out below, Hy-Vee’s motion is granted.
