BACKGROUND
On April 13, 1993, Plaintiff Western Farm Credit Bank (‘Western Farm”) filed this action to foreclose on certain loans upon which Defendant Hamakua Sugar Company (“Ha-makua”) defaulted. Defendant Theo. H. Davies & Co., Ltd. (“Davies”) now moves this Court to dismiss the action for lack of subject matter jurisdiction. Davies contends that no diversity exists under 28 U.S.C. §§ 1332, 1359 because diversity was created by a collusive assignment between Western Farm and Hawaii Production Credit Association (“HPCA”).…
