Action by C. M. Empson, receiver of the Exchange Bank of Ogallala, against V. E. Richter and Essie E. Davis to recover a balance alleged to be due upon two ■ promissory notes executed by the defendants in which the bank was named as payee. At the close of the evidence, on motion of the plaintiff, the court directed the jury to return a verdict in favor of the plaintiff and against both defendants for $7,385, being the amount claimed to be due by plaintiff after deducting a credit of $4,000, arising from the sale of certain cattle.
